1. All entry fees must accompany entry form.

2. Entry fees are set out herein and must be paid by the Exhibitor in full.

​

3. The use of amplifiers and loudspeakers is strictly prohibited.

​

4. The committee reserves the right to regulate the use of machinery on static display sites which produces excessive noise causing annoyance to other exhibitors or the public.

​

5. The committee of the Field Day shall have the power to enter the area at any time and remove any exhibits, article, sign, picture, or printed matter, which in their opinion may cause injury or damage or may be a cause of offence to the public or Officials of the Committee.

​

6. EXCEPT WITH THE WRITTEN CONSENT PREVIOUSLY OBTAINED OF THE COMMITTEE, THE EXHIBITOR SHALL NOT ASSIGN OR SUB-LET OR PART WITH THE POSSESSION OF THE WHOLE OR ANY PART OF THE SITE OR PURPORT TO DO SO.

7. The Exhibitor is responsible for the condition of the site covered by this Contract during the currency of the Agfair Broken Hill field days and upon completion of such Field Days the Exhibitor shall clean any part of the area affected by the Exhibitor's presence thereon to the satisfaction of the Committee.

8. The Exhibitor unreservedly accepts all responsibility for and shall hold Agfair Broken Hill it's servants and agents indemnified against any death, injury damage or loss to any person, persons or property howsoever arising and whether at or in consequence of the Field Day by reason of any act, omission or neglect of the Exhibitor or arising out of the transport, installation, use or demonstration of any machinery, implement, apparatus, static display or stand and the Exhibitor hereby undertakes to faithfully conform with any regulations, by-laws or ordinances made under such acts of parliament or by any government, semi-government or local government authority duly advised to make regulations by-laws or ordinances in connection herewith.

9. Agfair Broken Hill it's servants or agents shall not be liable for any loss of, or damage to, the Exhibitor's property whilst on the area. The Exhibitor specifically acknowledges that their property shall be at their own risk and that they will not hold Agfair Broken Hill, it’s servants or agents liable for any loss of property whether caused by the negligence of Agfair Broken Hill, it’s servants or agents. Security of the Exhibitor’s property or display shall be the responsibility of Exhibitors. There shall be no access to Exhibitor’s sites after 5:30pm from which time security patrols arranged by the Committee will operate.

10. If the Committee should find it necessary or expedient to cancel or postpone the Agfair Broken Hill field days this contract shall cease to operate upon notice to that effect, signed by the Chairman served on the Exhibitor by handing it to him personally or by posting it to him in a pre-paid envelope or wrapper at this address here mentioned or at the option of the Committee by handing it or offering it to any person who appears or is thought by the chairman to be an employee, agent or partner of the Exhibitor, and the Committee shall not be liable to the Exhibitor for any compensation whether on the ground of loss of profits or otherwise in respect of such cancellation or postponement and the Exhibitor shall not be entitled to any refund or payment of any money paid by the Exhibitor in relation to this application. In the event of cancellation by the Exhibitor, no refund will be paid for cancellations after Monday, 8th April), 2024.

 

11. This application properly signed by the Exhibitor shall be in the hand of the Secretary by 8 th April, 2024. Those received after that date are only accepted at the discretion of the Committee.

 

12. New equipment only may be displayed for sale. Used equipment of the current model may be brought on the ground only for use in demonstration. This condition is not applicable to the operators of light aircraft who have furnished light aircraft draft agreement.

 

13. Flag Poles over three metres in height are not permitted to be erected within two metres of any point directly below overhead power lines.

 

14. The Exhibitor shall not conduct or suffer to be conducted on the space any competition or game without authority of the committee.

 

15. The Committee and/or the Landholder on whose property the said Field Days are being held reserves the right to amend operating conditions as specified any time.

 

16. Livestock shall only be permitted on the area by prior arrangement with the Committee.

 

17. The Committee reserves the right to re-allocate any site which is not occupied by 7p.m. on Thursday, 1st May 2024.

 

18. EXHIBITOR'S PLEASE NOTE - Exhibitors will NOT be permitted to stay overnight at the Agfair site.

 

19. Exhibitors shall be issued with gate passes for each day of the field days. Such passes shall only be valid for admission on the day shown on the pass. Full gate admission charges are payable by employees or agents of exhibitors who do not possess a pass valid for the relevant day when admission is sought.

 

20. A speed limit of 10 kilometres per hour shall always apply within the confines of the said area.

 

21. Sale of alcoholic drinks within the confined of the said area is prohibited other than by the Official Caterer. No Exhibitor shall be permitted to infringe the rights of the field days official caterer.

 

22. The Committee reserves the right to cancel this Contract and to retain any money paid in relation thereto if there is in the opinion of the Committee any infringement of any of the foregoing conditions and/or if the Exhibitor does not occupy the space at the commencement of and during the full period of the said field days. Exhibitors are NOT to vacate sites before 5 p.m. Saturday 4th May 2024. This condition is not applicable to the operators or flight aircraft who have furnished light aircraft draft agreement.

 

23. The Committee reserves the right if it considers it necessary, expedient, or desirable to cancel or to suspend the operation of this contract by notice served on the Exhibitor as provided in Clause 11 in the event of any occurrence or happening which in the opinion of the committee justified it in so doing. Moreover, the Committee shall not be liable to pay the Exhibitor for any compensation whether on the grounds of loss of profits or otherwise or any refund of payment of any money paid by the Exhibitor in relation to this Contract in respect of such cancellation or suspension.

 

24. The Committee shall have the right to sell by public auction or private treaty any structure or part thereof or any plant or equipment which is or has been erected or placed upon the area and remains after the expiration of thirty days from the completion of the said Agfair Broken Hill Field Days and the Exhibitor shall pay a storage fee of $100 per item per week or part thereof. When it is necessary to charge a storage fee, the future attendance by that Exhibitor will be in jeopardy.

 

25. Agfair Broken Hill shall function through its Committee.

 

26. In these conditions unless the contrary appears:- *the area" shall mean the area defined by the external boundary fences of the Broken Hill Race-course Reserve. "the Exhibitor" shall mean the body corporate, person, partnership or voluntary association whose name appears on the application to exhibit and shall include the employees, servants and agents of the exhibitor. Words importing the singular number and shall include plural and the masculine gender the feminine or neuter and vice-versa and words importing persons shall include bodies corporate. Joint Exhibitors shall be jointly and severally bound by these conditions and shall have joint and several liability hereunder. "Site shall mean the space allocated by the Committee to an Exhibitor and shall include the immediate surrounds of such space.

 

27. The Agfair Broken Hill will have the right to restrict exhibitor numbers.
